FINKS TERMS OF SERVICE

These Terms of Service (“Terms”) govern your access to and use of the Finks platform and services. By accessing or using Finks, you agree to be bound by these Terms. If you do not agree, you must stop using the platform.

1. Definitions

  • Finks, we, us, or our refers to Finks, its parent company, and affiliates.
  • User, you, or your refers to any individual or entity using the platform.
  • Services means the tools, products, and insights offered by Finks, including financial research, AI-generated content, and portfolio tracking.
  • Content refers to the information, data, research, and materials available through Finks.
  • User Content refers to any content submitted by users through the platform.
  • Third-party Services refers to external services or data providers integrated with Finks.

2. Acceptance and Continued Use

By registering for an account or using Finks in any way, you agree to these Terms. Continued use of the platform after updates have been published also constitutes your acceptance of the revised Terms.

You may be asked to confirm acceptance when Terms are updated. We maintain a record of versioned user consent, including the timestamp of acceptance.

3. No Financial or Investment Advice

Finks does not provide financial, investment, tax, or legal advice. Any information, insights, or AI-generated content provided through the platform is for informational purposes only and should not be interpreted as professional advice.

You are responsible for your investment decisions. Use of the platform does not establish a financial advisory relationship.

4. User Account and Security

You are responsible for maintaining accurate account information and securing your login credentials. Unauthorized use of another user’s account is prohibited.

We may suspend or terminate accounts in cases of suspected fraud, security risk, or violation of these Terms.

5. Acceptable Use and Platform Restrictions

You agree not to:

  • Use the platform for illegal, fraudulent, or deceptive purposes
  • Scrape, extract, or copy content using automated tools
  • Attempt to reverse-engineer or tamper with Finks’ systems or underlying technology
  • Submit false, harmful, or misleading information
  • Use AI-generated content to mislead or defraud others

Violation of these rules may result in account termination.

6. Subscriptions, Fees, and Payments

Some features require a paid subscription. By subscribing, you authorize recurring billing to your chosen payment method.

Failure to pay may result in suspension or termination of access. Subscription fees are non-refundable unless otherwise required by law.

7. User Communications and Marketing

By using Finks, you agree to receive:

  • Transactional emails (e.g., security alerts, service updates)
  • Marketing emails about new features or offers
  • Invitations to participate in product surveys and research

You may opt out of marketing emails at any time. However, essential communications related to security, legal updates, or billing cannot be disabled.

8. Privacy and Data Usage

Use of Finks is governed by our Privacy Policy. By using the platform, you agree to how we collect, use, and protect your information as described there.

9. Third-party Services and Data Providers

Finks integrates with third-party services such as market data feeds and APIs. While we make efforts to ensure data quality, we do not guarantee the accuracy, completeness, or availability of third-party content.

Your use of third-party features is subject to their respective terms.

10. Limitation of Liability and No Guarantees

The Finks platform is provided “as-is” without warranties of any kind. We do not guarantee accuracy, reliability, or uninterrupted access.

Finks is not responsible for losses arising from your reliance on platform content or AI-generated information.

11. Termination and Account Suspension

You may close your account at any time.

We reserve the right to suspend or permanently terminate accounts for violations of these Terms, failure to pay, or suspicious activity. We are not responsible for any data loss following termination.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of Canada. Any dispute shall be resolved via binding arbitration in Ontario, Canada, under the rules of a recognized arbitration body.

You waive the right to trial by jury and to participate in class actions.

This section does not override protections afforded to residents of the European Union or California under their local laws.

13. Changes to These Terms

We may revise these Terms from time to time. If material changes are made, we will notify users via email or in-app messaging.

Your continued use of Finks following such changes constitutes acceptance of the revised Terms.

14. Force Majeure

Finks is not liable for delays or failure to perform caused by events beyond our control, including but not limited to natural disasters, wars, acts of government, or internet outages.

15. Disclaimer of Warranties

Finks provides its services “as-is” and “as available.” We disclaim all warranties, express or implied, including those relating to merchantability, accuracy, reliability, and fitness for a particular purpose.

16. Indemnification

You agree to indemnify and hold harmless Finks, its affiliates, employees, and partners from any claims or liabilities arising out of your use of the platform, your violation of these Terms, or misuse of AI-generated content.

17. Survival

Any section of these Terms that, by its nature, should survive termination (including those on intellectual property, limitations of liability, indemnification, and dispute resolution) will remain in effect even after your account is closed.
